| Booking Terms and Conditions |

1. Introduction
- 1.1 These are our booking conditions. Please read them carefully as they set out the terms of your booking and form a contract between you and us, and you and the owner of the villa (“Owner”).
In these booking conditions, 'you' or “your” means all persons named on the booking form (including anyone who is added or substituted at a later date). 'We', 'us' and 'our' means Tuscany Italy Ltd of 201 Beresford Road, Ely, Cambs, CB6 3WW, UK.
We act in the capacity of disclosed agents for the Owners. We accept no liability for the acts or omissions of any Owner in respect of the rental of the villa by you. We reserve the right to refuse a booking without giving any reason.
2. How to Book
- You must contact us before making a booking to obtain confirmation of availability.
- Once availability has been confirmed, you will be contacted to finalize your booking. You will receive an e-mail message asking for your details. The person who provides the details certifies that he/she is authorised to agree the Booking Terms and Conditions on behalf of all persons who will occupy the villa, including those substituted/added at a later date. This person must be a member of the party occupying the property and must be 18 years or over. Bookings cannot be accepted from parties of young people less than 18 years of age.
- Subject to availability, once your details have been received, a provisional booking will be made.
3. Payment
- A non-refundable deposit of fifty percent (50%) of the total rental cost must be paid to us to secure your reservation. We will confirm how the payment is to be made when confirming your provisional reservation. Payments can be received in Euros or Pounds Sterling.
- Once we receive the deposit, your reservation will be a confirmed reservation.
- The balance of the total rental cost must be paid not less than eight weeks prior to your arrival at the villa.

- We are entitled to treat your booking as cancelled if you fail to pay the balance on time and the cancellation policy set out below will apply.
- Bookings taken within nine weeks of your arrival at the villa must be paid in full.
4. Contract
- Once we have received your deposit, we will confirm your booking by sending you a voucher. Please check this carefully as soon as you receive it. Contact us immediately if any information which appears on the voucher seems to be incorrect or incomplete, as it may not be possible to make changes later.
- A binding contract between you and the Owner will come into existence on receipt of your deposit.
5. Rental
- The prices stated on the website for the rental are based per week, from Saturday to Saturday, unless otherwise stated.
- Villas are let fully furnished and equipped. The price for all villas includes linen, full cleaning services, and electricity up to a certain amount. Additional services and any exceptions are clearly stated in the individual villa description.
- We reserve the right to make changes to and correct errors in listed prices at any time before your rental is confirmed. We will advise you of any error of which we are aware of at the time of booking.
6. Security Deposit
- A security deposit is required to cover the cost of any damages or breakages to, or at the property, any additional cleaning, the cost of telephone and/or other services/utilities that are not included in the rental price. This amount will be payable by you direct to the Owner in cash in Euros when you arrive.
- The cost of utilities and/or other services used by you or any damage caused by you will be deducted from the security deposit and the remaining balance will be returned to you by the Owner when you depart the villa. If the security deposit paid by you is not sufficient to cover the cost of such utilities and/or services or damage, the Owner is entitled to recover any additional costs from you.
- It is your responsibility to make sure you deal with the arrangements for the security deposit. We can take no responsibility for any loss in relation to the security deposit.
- The Owner reserves the right to make deductions from the security deposit for any extra cleaning, over the number of hours committed to departure cleaning, and to claim against you for damage or loss, the cost of which exceeds the security deposit.
7. Alterations/Cancellations by the Owner
- In the unlikely event of a significant change or cancellation of your booking by the Owner, we will inform you as soon as possible. If requested and if available we will try to arrange alternative accommodation of a similar type, price, standard and location. Alternatively, you will receive a full refund, but we will not be liable to pay cancellation charges on your travel arrangements or for any other loss.
8. Cancellations by You
- Any cancellation by you (for whatever reason) must be in writing. (Including email or fax). The effective date of cancellation is the date we receive written notification. If you cancel after your deposit has been paid, you will lose your deposit.
- If you cancel after the balance has been paid, you will lose both deposit and the balance.
- We strongly recommend that you take out insurance to cover any cancellation.
9. Your responsibilities
- You must keep the villa and all furniture, fittings, facilities, equipment and grounds in the same state of repair and condition as at the commencement of the rental, and in the same state of cleanliness and general order in which it was found. You will be responsible for the payment for any breakages, loss or damage to the property caused by you. (We recommend that you take out adequate insurance cover to cover this).
10. Number of People using the Property
- Only the number of persons stated in the details provided may use the villa unless otherwise agreed with us and the Owner. The maximum number of people, including infants, allowed at the villa may not be exceeded. The Owner has the right to terminate hire without prior notice and without refund or compensation, if the numbers are exceeded. A pro rata sum will automatically be deducted from your security deposit for any additional adults/children.
11. Access
The Owner or their representative shall be allowed access to inspect the villa prior to your departure. They also have a right to access the villa during your stay to carry out maintenance. Gardeners and pool maintenance staff may enter the grounds during your stay.
12. Behaviour

The person providing the booking details is responsible for the correct and decent behaviour of the party. Should you or a member of the party not behave in such a manner, the Owner may use their absolute discretion to terminate the holiday of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the villa. Neither we nor the Owner will have any further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and neither we nor the Owner will pay any expenses or costs incurred as a result of the termination.
13. Additional Services at the Property
- Some services such as maids, cleaners and chefs are included in the price. Please note however that we do not take any commission, nor do we act as agent in respect of these services. Any contract you enter into for these services is with the supplier of the services concerned. We cannot accept responsibility for these services.
- Payment for these services is normally made on location, although some Owners may require a deposit to be paid prior to departure for items such as food.
14. Swimming Pools
- Swimming pools are not normally open all year round. If your rental period is outside July and August, please check with us that the pool is open, filled and ready for use. We cannot be responsible for low water temperatures at any period.
- Please note that swimming pools carry their own inherent risks. Upon arrival at the villa you and all members of your party must take time to familiarise yourselves with the location, layout, and depths of any swimming pool(s) at the villa. Please take note of any pool warning signs, depth markings and other instructions for use, which may be displayed. Young children must not be allowed to wander unaccompanied in the grounds of any villa where there is a swimming pool.
- You must ensure that all members of the party are familiar with any pool protection in place. You are fully responsible for ensuring that the alarm/fence or cover is in place at all times when the pool is not in use.
15. Security and Valuables
- Any valuables left at the villa are left at your own risk. Neither we nor the Owner are responsible for any loss. When provided, burglar alarms must be activated, safes used and proper care be taken against theft and burglary. It is essential and your responsibility to ensure all doors, shutters, windows are closed and locked when leaving the villa, or when by the poolside/in the grounds. No refund can be given should you decide to vacate the property as a consequence of a burglary; unless it can be proven that the Owner has failed to inform you of anti-burglary systems in the villa.
16. Arrival and Departure
- Unless otherwise agreed, arrival is between 1600 and 1800 local time. If your arrival is delayed you must inform the contact person, noted on the information pack that you will receive upon payment of the balance. If you arrive after 1800 (without making arrangement to arrive late) you may not be able to gain access to the villa until the following day.
- You must vacate the villa by 0930am on the day of departure. If these times cause you difficulty, please advise us at the time of booking. We will not be able to guarantee that any changes can be made after the booking.
17. Information
- While we make every effort to ensure the descriptions supplied by Owners are accurately reproduced on our website, we cannot accept responsibility for any descriptions which contain inaccurate, incomplete or misleading information or errors and which have been supplied by the Owner to us. You accept that minor differences between the photograph/illustration/text used and the actual villa may arise. Our website should not be relied upon by you as an indication that the villa is suitable in all respects for your needs or those of your party.
- Owners reserve the right to make modifications to the villa specifications that are considered necessary in light of operating requirements. In the interest of continual improvement Owners reserve the right to alter furniture, amenities, facilities, or any part of any activities, either advertised or previously available, without any prior notice.
- If we become aware of material changes after your booking has been confirmed, we will advise you before arrival.
- Distances given are approximate. Times are approximate, based on driving, not walking.
18. Pets
- Pets are not allowed unless otherwise stated and with the explicit permission of the Owner. The Owner reserves the right to charge a supplement, and/or increase the security deposit. The number of pets must be agreed prior to acceptance of booking.
19. Complaints
- In the event that you are disappointed with the villa, you must first contact us. We will liaise with the Owner to try to solve the problem.
- Complaints received at the end of the rental will not be accepted.
- If the problem was not resolved to your reasonable satisfaction during your rental, you should put your comments in writing within 7 days of your return. We will forward your written complaint to the Owner and will within reason liaise with the Owner to assist in reaching a satisfactory settlement for all justifiable complaints regarding the villa you may have. However, it is your responsibility to take the complaint up with the Owner directly, if no satisfactory settlement can be reached.
20. Our Liability and that of the Owner
- As we act only as agent for the Owner we cannot accept any liability for any act(s) or omission(s) of the Owner or anyone representing, or employed by, the Owner. Further, we cannot accept any liability for any shortcomings or defects with or in any villa as all properties are within the sole control of the Owners. If you have any complaints regarding any services we provide (as opposed to any provided by the Owner), you must inform us immediately in writing and in any event within 7 days of the end of any arrangements booked through us. We regret we cannot accept any liability if we are not so notified. Our maximum liability to you, if we are found to be at fault in relation to any service we provide, (as opposed to any service provided by any third party such as an Owner for whom we are not responsible), is limited to the commission we have earned, or are due to earn, in relation to the booking in question.
- Neither we nor the Owner can be held responsible for noise or disturbance originating beyond the boundaries of the villa or which is beyond the Owner's control. In the event that a source of reasonably obvious noise has been in existence prior to your arrival and we are informed of this, we will contact you to inform you of the disturbance.
- We cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, swimming pool filtration systems, nor for the failure of public utilities such as water, gas and electricity.
- We shall not be liable for any loss, breach or delay due to any cause beyond our reasonable control including, though not limited to act of God, explosion, tempest, fire or accident, war or threat of war, civil disturbances, acts, restrictions, regulations, bye-laws, or measure of any kind on the part of the government or local authorities, strikes, lock-outs, or other industrial actions or disputes or adverse weather conditions. In any case we shall be entitled to treat the contract as discharged.
- We cannot accept responsibility for events out of control e.g. bad weather, delay caused by carrier company, breakdown of domestic equipment.
21. Law
- This contract and all matters arising out of it are governed by English law. We both agree that any dispute, claim or other matter which arises out of or in connection with your booking, as opposed to your contract with the Owner for your actual stay at the property will be dealt with by the Courts of England and Wales only.
22. Data Protection
In accordance with the 1998 data Protection Act we will ensure that:
- The collation of personal information is fair and lawful.
- We take responsibility for all personal information held and used and that appropriate security measures are in place to protect this information.
- Some sensitive information may need to be passed on to third parties. This will only apply to instances where you have requested additional services e.g. the Owner or chefs when they require dietary information. We also request full details of all party members prior to departure as a safety measure whilst you are on vacation.
- Please let us know if you would like your personal details to be removed from our database, after your rental. We may use this data to update you on our services.
- By disclosing information to us you consent to the collection, storage and processing of your personal information.
